1. Scope & contracting parties

These General Terms and Conditions (hereinafter "GTC") apply to all contracts for dog and cat grooming services concluded between GroomRoom Berlin GmbH, Giesebrechtstraße 2, 10629 Berlin (hereinafter "GroomRoom" or "we") and the client (hereinafter "customer" or "pet owner").

By booking an appointment, whether online, by phone, via WhatsApp, E-Mail or in person at the salon, you accept these T&Cs as valid at the time of booking. Any differing, conflicting or additional terms on your part will not become part of the contract unless we expressly agree to them in writing.

2. Services & appointment cancellations, cancellation fees

All dog grooming treatments at GroomRoom Berlin are carried out in accordance with these terms and conditions and professional quality standards. Keeping your pet healthy and ensuring animal welfare is at the heart of everything we do.

GroomRoom Berlin generally reserves the right to accept or decline bookings, and carrying them out is at the discretion of GroomRoom Berlin GmbH. We work by appointment only.

If you can't make it, please cancel your appointment in good time, at least 24 hours in advance, so we can offer the slot to someone else. For appointments cancelled at short notice (less than 24 hours before) or no-shows, our dog grooming salon reserves the right to invoice a cancellation fee of 70 percent of the booked grooming service price (§ 642 paragraph 2 BGB; saved expenses are already factored in).

If the cancellation fee is not paid, we will instruct a partner law firm to initiate legal debt collection proceedings, and all necessary personal data of the person who made the booking will be transferred to them.

All dogs are washed and shampooed with professional dog shampoo before their treatment. As the owner, you agree not to book in any dogs with pre-existing medical conditions.

We do not groom dogs in the presence of their owners, as this can cause unnecessary delays, disrupt the grooming process, and prevent a stress-free visit for your dog. If you'd like to stay on-site during the treatment, please wait in the waiting area next door. By booking an appointment, you agree to this policy.

3. Prices & Payment

The prices shown in the service overview during the booking process and in our current price list apply to regularly groomed, mat-free dogs that match the standard size of their breed.

The scope of services based on our price list is agreed upon before we start. Any additional work that becomes necessary during the groom to meet our quality standards is considered agreed upon, provided the extra costs do not exceed 60,- €.

Additional or separately booked services include in particular:

• De-matting
• Any grooming products required for this
• Parasite treatment

Delays caused by a restless dog or interruptions from the owner will be charged as additional time.

An additional fee of at least 19 € will be charged if your dog is prone to biting, you fail to tell us when dropping them off, and a bite occurs.

Payment for the grooming, based on our price list, these terms and conditions, and your booking, is due immediately when you pick up your pet, in cash or by debit/credit card. We do not offer grooming on account.

4. Liability

You confirm that there have been no previous incidents involving your pet(s) that had to be reported to the authorities.

By booking an appointment, you also confirm that your pet has no allergies, especially not to ingredients in professional dog shampoos from the manufacturer LT-Naturprodukte e.K. and others. You further confirm that your pet has no acute or chronic pre-existing conditions and does not need to take any medication.

We want your dog to find their stay at our dog grooming salon as pleasant and stress-free as possible. For very restless dogs, the risk of injury can increase. The same applies to dogs with heavily matted coats. In both cases, we accept no liability.

In cases of severe matting, de-matting can cause skin irritation, redness, and so-called ear haematomas. GroomRoom Berlin GmbH cannot be held liable for this; the owner is solely responsible. Liability for illnesses caused by possible allergic reactions to dog shampoos & conditioners, as well as covering the costs for resulting vet visits, is explicitly excluded.

Injuries to our staff caused by your dog must be covered by your dog liability insurance. By concluding the contract and booking, you confirm that you have appropriate dog insurance.

For large and snappy dogs, we ask you to be present during the groom. For snappy dogs, please understand that a muzzle must be worn. A valid liability insurance policy is mandatory for all dogs.

If your pet becomes ill or injured during their time with us, we will primarily contact their regular vet. If they cannot be reached, GroomRoom Berlin GmbH reserves the right to consult another vet or a veterinary clinic. Any resulting costs are to be borne solely by you.

GroomRoom Berlin GmbH cannot be held liable for damages or illnesses that your pet suffers while you are absent or during the grooming time. The liability of GroomRoom Berlin GmbH is strictly limited to intent and gross negligence. If culpably caused damages occur during the provision of services, GroomRoom Berlin GmbH is liable within the scope of an existing public liability insurance.

Damages must be reported to GroomRoom Berlin GmbH immediately upon discovery. GroomRoom Berlin GmbH is not liable if:

• damages are caused by force majeure,
• despite precautionary measures, the pet escapes and causes damage to us or third parties,
• damages are caused by grooming products despite proven compatibility,
• the pet is injured during our work due to severe matting or excessive restlessness, despite precautionary measures taken in this regard.

Please check your pet for any grooming issues immediately after the treatment so we can correct them right away. We cannot accept complaints made at a later time. Refunds of paid amounts are not possible.

If there is a flaw on our part that cannot be corrected immediately, GroomRoom Berlin GmbH is entitled to at least two attempts to rectify it before the dog owner can claim compensation or additional costs.

5. Photos & videos

Before and after the grooming treatment, GroomRoom Berlin may take photos and videos of your dog to use on our company Instagram, Facebook, TikTok and Google Business profiles. GroomRoom Berlin GmbH may use these photos & videos without any time or geographical restrictions.

You accept this agreement when booking an appointment. If you do not agree, please let us know in writing before the treatment to object to their use. All rights to the photos and videos taken by GroomRoom remain solely with GroomRoom Berlin GmbH.

6. Collection & data protection

After the treatment, your pet must be collected by you personally, by someone known to us, or by a third party with your written authorisation.

Any data stored about you or your pet is treated confidentially in accordance with data protection regulations. You can find details on how we process personal data in our privacy policy.

7. Video surveillance in the salon

All treatments are recorded on video so we can clear up any misunderstandings beyond doubt at a later date. All video recordings are always permanently deleted after 30 calendar days. By booking a salon service and entering into a contract, you agree to video recording on the premises.

8. Applicable law & final provisions

German law applies exclusively. For consumers, this choice of law only applies provided it does not restrict any mandatory statutory provisions of the country in which they are domiciled or habitually resident.

The place of jurisdiction is Berlin.

If any parts of these terms and conditions are or become invalid, they will be replaced by provisions that come closest to the intended commercial outcome. The validity of the remaining provisions remains unaffected.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.
